Sorry if this is in the wrong place, But I have having a strange issue with the mod

Are you playing a stock scenario? Are you using a stock OOB or a KS OOB? Do you have any other mods activated?

French waterloo, no other mods installed, just the three packs on here

I still don't know what you mean by "French Waterloo". Is it a stock scenario and OOB (ones that come with the game) or a KS OOB in a sandbox game?
In the KS Mod its extremely rare to capture enemy guns. About 90% of the time they will withdraw, about 9% of the time they will surrender (white flag then vanish) and about 1% of the time you actually capture them. These often have such ragged morale they then rout away anyway.
We disagree with the capturing and re-crewing mechanism NSD put into the game (and into Gettysburg before it as well). It is complete fantasy and happened so very rarely in both the ACW and Napoleonic period that we decided to just remove it.

I mean the whole waterloo battle playing as the french.
In the other scenarios I can easily capture and recrew guns, so I dont know why the mod is breaking there. Always capture and recrew

The mod isn't breaking. It is not designed to be used with the stock scenarios and the stock OOBs. It may work with them or it may not, we don't know because we didn't test it with them (our group has no interest in playing the stock scenarios). In this case it sounds like it is one area of incompatibility between the stock game and the mod. This isn't surprising as the mod changes a lot of things, artillery capture being just one.
If you play a sandbox or MP game using one of the KS OOBs you will get the intended mod behaviour of guns not being captured but withdrawing which is historically what most frequently happened.
The mod was written mainly for MP games. It will also work in SP sandbox play and can be used with the sandbox campaign. If your preference is to play the stock scenarios the mod is probably not going to be suitable.

The problem may be that you are trying to play the stock scenarios by pushing the "Waterloo Battles" button. If you do that only a piece of the KS mod is used and part of the stock behavior is used. That won't work.
What you need to do is download the Waterloo SDK. Create a sub-folder in your Mods folder, call it Stock Scenarios. Now copy the scenarios folder you find in the SDK into the Stock Scenarios folder. To access the stock scenarios, start the game and press the "User Scenarios" button. You should see the stock scenarios there along with the KS scenarios.
